二、服务内容与使用许可
XYZMaker 提供视频、动态照片、GIF 和 LMR 相关的转换、编辑、保存与还原功能，以及二维码动态照片制作、全景照片浏览、批量转换和作品管理等功能。实际可用功能以你使用的应用版本、设备条件和会员权益为准。
在你遵守本条款及适用的 App Store 使用规则的前提下，我们授予你有限、非独占的使用许可，允许你在自己拥有或控制的兼容设备上使用 XYZMaker。
应用本身的代码、界面、商标及我们提供的原创资源受知识产权法律保护。本许可不转让上述知识产权，也不限制第三方开源组件依其许可证授予你的权利。
通过 App Store 获取应用时，还应遵守适用的 Apple 平台条款及应用许可协议。本条款不替代或修改你与 Apple 之间的协议。
三、使用资格与未成年人
你应具备适用法律要求的相应民事行为能力。
如果你尚未达到所在地法律规定的成年年龄，或无法独立同意本条款，应在父母或其他监护人的指导与必要同意下使用服务。未成年人进行付费购买，应取得所需的监护人授权。
四、你的素材与使用责任
你对导入、转换、编辑、保存和分享的素材，应拥有相应权利或合法授权。
使用 XYZMaker 不会使我们取得你原始素材或依法享有的生成作品的所有权，也不授予我们将这些内容用于广告、宣传或其他无关用途的权利。
XYZMaker 主要在设备本地处理媒体，不是面向公众发布用户内容的社区平台。你主动通过系统分享、聊天软件、网盘或其他服务发送文件时，接收方及相关第三方将按其规则处理这些文件。
你不得利用 XYZMaker：
- 侵犯他人的著作权、商标权、隐私权、肖像权或其他合法权益；
- 制作或传播适用法律禁止的内容；
- 实施诈骗、冒充、骚扰，或制作具有欺骗性的二维码；
- 传播恶意代码、破坏服务，或未经授权访问系统和数据；
- 非法绕过付费验证、技术保护措施或访问限制。
适用法律明确允许的行为，不因本条款而受到不当限制。
你通过反馈渠道提供素材时，应确保有权提供；我们仅在处理该反馈所必要的范围内使用。涉及他人个人信息的，请在提供前采取必要的遮挡、删除或其他保护措施。
五、转换效果、兼容性与文件保存
转换结果和处理速度可能受到素材编码、分辨率、帧率、时长、可用存储空间、设备性能及系统版本影响。部分素材可能无法转换，或者在转换后出现画质、声音、元数据或播放效果的变化。
动态照片生成成功，不代表一定能设置为动态锁屏壁纸。壁纸适用性、播放时长和交互方式由设备、系统和素材条件共同决定。第三方平台对 GIF、视频及其他文件的接收和展示规则也可能不同。
二维码的识别效果取决于内容、尺寸、清晰度、背景及展示环境。请在分享或实际使用前检查二维码的内容和识别结果。
建议你保留重要原始素材，并在删除原文件或向他人交付作品前检查转换结果。卸载应用、删除作品、设备故障或系统操作可能造成应用本地文件丢失；系统相册和外部存储中的文件受相应服务管理。
上述说明用于解释使用条件，不免除我们依法应承担的产品质量、服务履行或损害赔偿责任。
六、XYZMaker Pro 与付款
- 购买项目
XYZMaker 可能提供按月、按年自动续订的 Pro 会员，以及一次性购买的终身会员。可购买项目、价格、币种、权益和优惠条件，以购买时应用内及 App Store 确认页面的说明为准。
- 付款
确认购买后，费用由 Apple 通过你的 Apple 账户收取。
- 自动续订
月度和年度订阅会持续自动续订，除非取消。为避免下一周期续费，请至少在当前订阅期结束前 24 小时取消。
Apple 会在订阅期结束前的 24 小时内尝试扣款，续订成功后按所购方案延长一个月或一年。续订价格及任何价格变更，以 Apple 提供的购买、续订或变更通知为准。
- 管理与取消
可前往 iPhone“设置”→ 你的姓名 →“订阅”→ XYZMaker，查看和管理订阅。
取消自动续订通常不影响当前已付费周期内的使用权益。卸载应用、停止使用应用或删除本地文件不会自动取消订阅。
- 终身会员
终身会员属于一次性购买项目，不会按月或按年自动续费。其权益以购买时明确列示的内容为准，不因后续修改本条款而任意缩减。
名称本身不构成对所有未来独立产品、未承诺服务或所有未来系统兼容性的保证。本说明不限制购买时明确承诺的权益或你依法享有的权利。
- 恢复购买
已购用户可使用原购买 Apple 账户，通过应用提供的恢复购买功能或购买状态同步，恢复可恢复的权益。遇到问题时，可以联系我们协助排查。
- 退款
通过 App Store 完成的购买，可向 Apple 申请退款，由其依适用规则处理。本条款不限制你依据适用消费者保护法律享有的退款或其他救济权利。
- 权益调整
价格、订阅及权益调整将遵守适用法律和 Apple 的通知、同意等要求，不追溯改变已经完成的购买。
七、广告、统计与第三方服务
根据应用识别的 App Store 国家或地区，XYZMaker 使用不同的广告和统计服务：
中国大陆：
穿山甲／GroMore 广告服务及友盟统计。
中国大陆以外：
Google AdMob 广告服务及 Firebase Analytics。
实际启用情况取决于地区识别结果、授权状态、会员权益和功能配置。确认有效 Pro 会员身份后，应用不展示广告。
可选使用情况统计将在取得所需同意后启用。你选择暂不启用统计，不影响转换功能。
广告相关授权与统计授权按其适用规则分别处理；有关个人信息类型、用途、接收方和权利行使方式，请阅读隐私政策。本条款不替代依法需要的隐私告知或单独同意。
第三方广告、网站和服务由相应提供方负责。展示广告或链接不代表我们对其商品或服务作出保证，但不影响我们依法应承担的责任。
八、服务变更、中断与终止
我们可能为修复问题、适配系统、保障安全或遵守法律而更新或调整服务。
对实质影响已购权益的变更或服务停止，我们将在合理可行的情况下提前通知，并依法妥善处理受影响的付费权益，包括在适用情况下提供继续履行、替代安排或退款等解决方式。
如果存在严重违法使用、实质违反本条款或紧迫安全风险，我们可在必要、合理的范围内限制相关服务。除法律禁止通知或存在紧急情况外，我们会说明原因，并在适当情况下提供纠正或申诉机会。
你可以随时停止使用应用。停止使用或卸载应用不代替取消自动续订的操作，也不影响双方此前已经产生的权利和义务。
九、责任与法定权利
我们将以合理的技能和注意提供、维护服务，但无法保证所有设备和素材始终兼容，也无法保证服务完全不中断或不存在任何错误。
因任何一方违反本条款造成损失，应依适用法律，根据过错、因果关系及其他相关因素确定责任。
本条款不排除或限制依法不得排除或限制的责任，包括适用法律规定的人身损害责任、因故意或重大过失造成的财产损失责任，以及消费者依法享有的权利。
十、条款更新、转让与争议处理
我们可能更新本条款，并在本页面列明更新日期和生效日期。
涉及付费权益、责任安排或其他重大利益的变更，将以合理方式提示；依法需要再次同意的，将重新征求同意。更新不会追溯剥夺你已取得的权利。
如果服务经营主体发生变更，我们会依法通知，并确保相关义务获得承接；依法需要你同意的，将事先取得同意。
发生争议时，你可先联系我们协商。协商不成的，任何一方均可向依法具有管辖权的法院寻求救济。本条款不剥夺你依法向消费者保护机构投诉或使用其他法定争议解决渠道的权利。
本条款受依法应适用的法律约束，不排除你通常居住地法律中依法适用的强制性消费者保护规定。
某项条款被认定无效，不影响其他可独立执行条款的效力。
中英文版本旨在表达相同内容；出现差异时，应结合上下文、适用法律及消费者保护原则解释，不得仅凭语言差异减损你的法定权利。

- Scope and Acceptance
Welcome to XYZMaker. These Terms of Service govern your use of the XYZMaker app and related services. The service provider is the developer identified on XYZMaker’s App Store product page, referred to as “we,” “us,” or “our.”
Please read these Terms before using the services, particularly the provisions concerning paid memberships, automatic renewal, service limitations, and liability. Contact us using the details below if you have questions.
After you have had a reasonable opportunity to review these Terms, your express acceptance—or your use of the relevant services where recognized by applicable law—constitutes agreement to these Terms. If you disagree, please stop using the relevant services.
Our Privacy Policy separately explains how personal information is processed. Accepting these Terms does not constitute consent to all optional data collection. Any authorization or consent that must be obtained separately will be requested separately.

- Services and License
XYZMaker provides conversion, editing, saving, and restoration features for videos, Live Pictures, GIFs, and LMR files, together with QR-code Live Picture creation, panoramic photo viewing, batch conversion, and creation management. Available features depend on your app version, device capabilities, and membership entitlements.
Subject to these Terms and applicable App Store usage rules, we grant you a limited, non-exclusive license to use XYZMaker on compatible devices that you own or control.
The app’s code, interface, trademarks, and original resources provided by us are protected by intellectual property laws. This license does not transfer ownership of those rights or restrict rights granted under applicable third-party open-source licenses.
When obtaining the app through the App Store, you must also comply with applicable Apple platform terms and application license agreements. These Terms do not replace or modify your agreements with Apple.
- Eligibility and Minors
You must have the legal capacity required under applicable law.
If you have not reached the age of majority where you live, or cannot independently agree to these Terms, use the services with the guidance and any required consent of a parent or legal guardian. Purchases by minors require any legally necessary guardian authorization.
- Your Materials and Responsibilities
You must own or have appropriate permission to import, convert, edit, save, and share your materials.
Using XYZMaker does not transfer ownership of your original materials or any rights you lawfully hold in your creations to us. It also does not grant us permission to use them for advertising, promotion, or unrelated purposes.
XYZMaker primarily processes media locally on your device. It is not a public user-content publishing platform. When you choose to send files through system sharing, messaging apps, cloud storage, or other services, the recipients and relevant third parties process those files under their own rules.
You must not use XYZMaker to:
- Infringe copyright, trademark, privacy, image rights, or other legal rights;
- Create or distribute content prohibited by applicable law;
- Commit fraud, impersonation, or harassment, or create deceptive QR codes;
- Distribute malicious code, disrupt services, or access systems or data without authorization;
- Unlawfully bypass payment verification, technical protection measures, or access restrictions.
These restrictions do not improperly limit activities expressly permitted by applicable law.
If you provide materials when requesting support, you must have permission to provide them. We will use those materials only as necessary to handle your request. Before sharing another person’s personal information, take appropriate protective steps such as masking or removing it.
- Conversion Results, Compatibility, and Storage
Conversion results and processing speed may depend on encoding, resolution, frame rate, duration, available storage, device performance, and operating system version. Some materials may not convert successfully, or their image quality, audio, metadata, or playback may change.
Successfully creating a Live Picture does not guarantee that it can be used as an animated Lock Screen wallpaper. Wallpaper eligibility, playback duration, and interaction depend on the device, operating system, and media. Third-party platforms also have their own file acceptance and display requirements.
QR-code recognition depends on the content, size, clarity, background, and display environment. Check the code’s content and recognition results before sharing or using it.
Keep copies of important originals and check converted results before deleting source files or delivering creations to others. Uninstalling the app, deleting creations, device failures, or system operations may result in the loss of app-local files. Files in your system photo library or external storage are managed by the corresponding services.
These explanations describe usage conditions. They do not waive our legally required obligations concerning product quality, service performance, or compensation for loss.
- XYZMaker Pro and Payments
6.1 Purchase Options
XYZMaker may offer monthly and annual auto-renewable Pro subscriptions and a one-time lifetime membership. Available products, prices, currencies, benefits, and promotional conditions are those disclosed in the app and on the App Store confirmation screen when you purchase.
6.2 Payment
After confirmation, Apple charges the purchase to your Apple Account.
6.3 Automatic Renewal
Monthly and annual subscriptions renew automatically unless canceled. To avoid renewal for the next period, cancel at least 24 hours before the current subscription period ends.
Apple attempts to collect renewal payment during the 24 hours before expiration. Successful renewal extends the subscription by one month or one year, depending on your plan. Renewal prices and any price changes are those disclosed through Apple’s purchase, renewal, or change notices.
6.4 Managing and Canceling
On your iPhone, go to Settings → your name → Subscriptions → XYZMaker.
Canceling automatic renewal normally leaves your benefits available until the end of the current paid period. Uninstalling the app, stopping its use, or deleting local files does not cancel a subscription.
6.5 Lifetime Membership
Lifetime membership is a one-time purchase without automatic monthly or annual charges. Its benefits are those expressly disclosed at purchase and will not be arbitrarily reduced through later changes to these Terms.
The name does not itself guarantee access to every future standalone product, unpromised service, or compatibility with every future operating system. This explanation does not limit benefits expressly promised at purchase or your statutory rights.
6.6 Restoring Purchases
Eligible purchases may be restored through the app’s restoration feature or purchase-status synchronization using the Apple Account used for the original purchase. Contact us if you need help investigating a restoration issue.
6.7 Refunds
Refunds for App Store purchases may be requested from Apple and are handled under its applicable procedures. These Terms do not limit refund rights or other remedies available under applicable consumer protection laws.
6.8 Changes to Benefits
Changes to prices, subscriptions, or benefits will follow applicable law and Apple’s notice and consent requirements. They will not retroactively change completed purchases.
- Advertising, Analytics, and Third-Party Services
XYZMaker uses different advertising and analytics services according to the App Store country or region identified by the app:
Mainland China:
Chuanshanjia / GroMore advertising services and Umeng Analytics.
Outside mainland China:
Google AdMob and Firebase Analytics.
Actual activation depends on region identification, authorization status, membership benefits, and feature configuration. The app does not display ads after a valid Pro membership has been confirmed.
Optional usage analytics are enabled after obtaining any required consent. Declining optional analytics does not affect conversion features.
Advertising-related permissions and analytics consent are handled separately under their applicable requirements. See the Privacy Policy for information about data categories, purposes, recipients, and your rights. These Terms do not replace any legally required privacy notice or separate consent.
Third-party advertisements, websites, and services are the responsibility of their providers. Displaying an advertisement or link does not constitute our guarantee of the advertised product or service. This does not exclude any responsibility we have under applicable law.
- Service Changes, Interruptions, and Termination
We may update or adjust the services to fix issues, support operating systems, maintain security, or comply with law.
Where reasonably practicable, we will provide advance notice of discontinuation or changes that materially affect purchased benefits. We will address affected paid entitlements as required by law, including continued performance, alternative arrangements, or refunds where applicable.
Where there is serious unlawful use, a material breach of these Terms, or an urgent security risk, we may restrict relevant services to a necessary and proportionate extent. Unless notice is legally prohibited or urgent circumstances prevent it, we will explain the reason and, where appropriate, provide an opportunity to remedy the issue or appeal.
You may stop using the app at any time. Stopping use or uninstalling the app does not replace subscription cancellation or affect rights and obligations that have already arisen.
- Liability and Statutory Rights
We will provide and maintain the services with reasonable skill and care. We cannot guarantee compatibility with every device or media file, uninterrupted availability, or the complete absence of errors.
Liability for loss resulting from either party’s breach will be determined under applicable law, taking account of fault, causation, and other relevant factors.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for personal injury, property damage caused intentionally or through gross negligence, and mandatory consumer rights.
- Updates, Transfers, and Disputes
We may update these Terms and identify the updated and effective dates on this page.
Changes materially affecting paid benefits, liability, or other significant interests will be brought to your attention in a reasonable manner. We will obtain renewed consent where required by law. Updates will not retroactively remove accrued rights.
If the service provider changes, we will provide any required notice and ensure that relevant obligations are assumed. Where your consent is legally required, we will obtain it beforehand.
If a dispute arises, you may contact us to seek a resolution. If it cannot be resolved, either party may seek relief in a court with lawful jurisdiction. These Terms do not remove your right to contact consumer protection authorities or use other legally available dispute-resolution channels.
These Terms are subject to the law applicable under relevant legal rules. They do not exclude mandatory consumer protections applicable in your country of habitual residence.
If a provision is invalid, the remaining independently enforceable provisions continue to apply.
The Chinese and English versions are intended to express the same terms. Any difference should be interpreted in context and consistently with applicable law and consumer protection principles. Language differences must not be used to diminish your statutory rights.
