本条款适用于所有使用 XYZDay（“本 App”）的用户。请在使用前阅读本条款、隐私政策和适用的最终用户许可协议。使用本 App 即表示你同意本条款；若你不同意，请不要使用本 App。本条款不减损适用法律赋予你的强制性权利。
1. 使用许可
在遵守本条款、所在平台规则及适用法律的前提下，你可在自己拥有或控制的兼容设备上使用本 App。本 App 的软件、设计、商标及其他内容的权利归应用提供方或其许可方所有，不因本条款转让给你。
2. 禁止用途
- 使用、提交或传播侵犯他人著作权、商业秘密、隐私权、肖像权或其他权利的内容，除非你拥有相应权利或已获授权；
- 发布可能损害本 App 或任何第三方的虚假信息；
- 提交违法、淫秽、诽谤、威胁、骚扰、仇恨、歧视性内容，或鼓励构成犯罪、产生民事责任或违反法律的行为；
- 上传或传播含有病毒或其他旨在中断、破坏或限制软硬件或通信设备功能的代码、文件或程序；
- 干扰本 App、系统或他人设备与服务的正常运行；
- 冒充他人。
3. 你的内容与第三方内容
你对自己使用本 App 生成、转换或查看的内容负责，并应确认拥有必要的权利；我们不会收集这些内容。你通过本 App 接触的第三方内容或链接由其提供方负责；我们不对第三方商品或服务作出保证，但不影响我们依法应承担的责任。
4. 费用与广告
XYZDay 免费使用，不展示广告，没有 App 内购买或订阅。未来如提供收费项目，会在购买前展示价格、权益和条件，并通过适用平台流程确认；本条款不构成对未来收费或自动续费的预先同意。
5. 隐私
隐私政策说明本 App 如何处理信息，是本条款的一部分。
6. 可用性、更新与中止
功能依赖设备、系统版本、权限、存储空间、网络及第三方服务状态。我们不承诺XYZDay永久可用、兼容所有设备与文件，或不会中断。我们可能修复、更新或调整功能；若重大变化影响你的权利或需要新的授权，将按适用要求通知或征求同意，并尊重你已有的有效付费权益。你可随时停止使用并卸载本 App。
7. 责任与适用权利
本 App 按届时可用的功能提供。在法律允许的范围内，我们不保证所有设备、内容或外部服务均能正常使用，也不对不受我们控制的网络、平台或第三方配置作出承诺。任何免责或责任限制仅在适用法律允许的范围内适用，不排除依法不得排除的保证、消费者救济或其他责任。
本条款不设定超出法律允许范围的用户赔偿义务，不要求你放弃依法享有的诉讼、投诉或消费者保护权利。争议应依据适用法律通过协商或有权机关解决。
8. 未成年人
未达到所在地独立订立合同或个人信息同意年龄的用户，应在监护人指导及必要同意下使用和购买。
9. 许可、条款更新与联系
App 的软件使用许可另见最终用户许可协议（EULA）。通过 Apple App Store 获得且没有有效自定义许可协议的版本，适用 Apple 标准 EULA 及 Apple 媒体服务条款中的使用规则。本条款不扩大或缩减强制适用的平台许可。
我们会在本页标注更新日期；重大修订按适用要求通知，需要另行同意的处理不会仅以继续使用代替同意。中英文版本意图一致，强制性法律及适用的语言保护优先。

These terms apply to all users of XYZDay (“the app”). Read them with the Privacy Policy and the applicable EULA. By using the app you agree to these terms; if you do not, do not use it. Mandatory legal rights remain unaffected.
1. License
Subject to these terms, the rules of your platform and applicable law, you may use the app on compatible devices you own or control. Rights in the app’s software, design, trademarks and other content belong to the provider or its licensors and are not transferred to you.
2. Prohibited use
- using, submitting or distributing material that infringes copyright, trade secrets, privacy, publicity or other rights unless you own or are licensed to use them;
- publishing false information that may harm the app or any third party;
- submitting unlawful, obscene, defamatory, threatening, harassing, hateful or discriminatory material, or encouraging criminal or unlawful conduct;
- uploading or transmitting viruses or other code, files or programs designed to interrupt, destroy or limit software, hardware or telecommunications equipment;
- disrupting the app, the OS or other people’s devices and services;
- impersonating others.
3. Your content and third-party content
You are responsible for content you generate, convert or view with the app and must hold the necessary rights; we do not collect that content. Third-party content or links you encounter are the responsibility of their providers; we give no warranty for third-party goods or services, without affecting liability we bear by law.
4. Fees and advertising
XYZDay is free to use, shows no ads and has no in-app purchases or subscriptions. Any future paid offering will show its price, benefits and conditions before purchase and use applicable platform confirmation; these terms do not pre-authorize future charges or renewals.
5. Privacy
The Privacy Policy explains how the app handles information and forms part of these terms.
6. Availability and changes
Features depend on the device, OS version, permissions, storage, network and third-party services. We do not promise that XYZDay will always be available, compatible with every device or file, or uninterrupted. We may fix, update or change features; material changes affecting your rights or requiring new permission will be handled under applicable notice/consent requirements, and valid purchased benefits will be respected. You may stop using and delete the app at any time.
7. Responsibility and legal rights
The app is provided with the features available at the time. Where the law permits limitations, we do not guarantee operation with every device, content item or external service, or configurations outside our control. Any disclaimer or limitation applies only to the extent permitted by law and does not remove non-excludable warranties, remedies or responsibility.
These terms impose no indemnity beyond what the law permits and do not require you to waive court, complaint or consumer-protection rights. Disputes should be resolved by agreement or by competent authorities under applicable law.
8. Minors
If you are below the local age for independent contracts or data consent, use and purchase only with guardian guidance and any required permission.
9. License, revisions and contact
Software licensing is described in the End User License Agreement (EULA). App Store versions without a valid custom license are governed by Apple’s Standard EULA and the usage rules in the Apple Media Services Terms. These terms do not override mandatory platform licensing.
Revisions carry an updated date on this page; material changes are notified as required, and continued use alone will not replace any consent that is separately required. Both language versions are intended to be consistent; mandatory law and language protections prevail.
